SUMMARY:

Assists the Chief Legal Officer in preparing and organizing a wide array of legal documents, reports, claims, contracts, agreements, and litigation management files. May perform functions in claims and/ or contract.  For claims performs routine legal research and investigations related to claims and litigation. Maintains and updates the individual claims management files. Screens and maintains billings from outside counsel. Coordinates with outside counsel for the scheduling of interviews, depositions, and discovery requests.   For contracts, responsible for ensuring timely and accurate execution of agreements, maintenance of electronic contract management database, and production and upkeep of standardized contract templates and related forms.

ESSENTIAL FUNCTIONS:

Claims:

Supports the Chief Legal Officer, Associate General Counsel, and claims management staff in the completion of various projects.

Establishes and maintains legal and claims files and records on an ongoing basis so that information can be quickly retrieved; appropriately disposes of or archives files per legal requirements.

Posts data to various records and forms, makes and maintains charts, gathers data from various sources and prepare reports, answers and files correspondence, and performs similar duties requiring the exercise of independent judgment and knowledge of claims.

Coordinates with TMC’s insurance carriers and Group Liability Plan (GLP) to maintain claim documentation in accordance with audit requirements, facilitate auditor meetings, and complete initial reporting of professional and general liability claims and potential claims to insurance carriers. Scan and log third party certificates received in preparation for evaluation. Provided monthly report of claims related expenses for GLP reimbursement process.

As directed by the Chief Legal Officer, assists nurse investigators with the investigation of significant adverse events and claims.

Maintains files and processes attorney invoices in accordance with the Legal Department’s claims management guidelines.

Assists with inventory management and ordering of office supplies.

Maintains standard form bank for the handling of each case.

Collaborates with outside counsel retained for specific problems and assignments.

Coordinates scheduling of depositions, participates in interviews for hospital staff with litigation attorneys or other case representatives.

Ensures compliance with Civil Litigation Rules, Clerk of Court, and Court Rules.

Assists with maintaining corporate meeting Minutes Books and Annual Reports; drafting corporate resolutions.

Updates research and information sources, including subscriptions to internet or CD format law databases, regulatory manuals, case law references, and other references as directed by management.

Retrieves information requested by members of Legal Department. 

Performs related duties as assigned.

Contracts:

Supports the Chief Legal Officer and Associate General Counsel in preparing, reviewing, executing, and modifying a variety of contracts, letters, and memoranda for the Legal Department.

Establishes procedures for receipt, tracking, review, and fulfillment of Legal Department contract requests in a timely manner.

Supports maintenance of organizational contract database system by overseeing the execution and administration of Legal Department contracts.

Establishes and maintains new or modified contract request files and records; appropriately disposes of or archives files per legal requirements and department procedures.

Posts data to various records and forms, makes and maintains charts, gathers data from various sources and prepare reports, answers and files correspondence and performs similar duties requiring the exercise of independent judgment and knowledge of contracts.

Maintains and creates standard templates for all commonly used contract types.

Supports contract drafting and review processes for other departments, including Contracting, Recruiting, and System/Hospital Administration.

Ensures Legal Department compliance with federal regulations governing excluded individuals and entities.

Composes letters and memoranda from knowledge of hospital policy or procedures or at the direction of the SVP/CLO or Associate General Counsel(s).

Performs related duties as assigned.

 

MINIMUM QUALIFICATIONS

EDUCATION: Bachelor’s degree or an equivalent combination of relevant education and experience.

EXPERIENCE: None required.

LICENSURE OR CERTIFICATION: None required.

KNOWLEDGE, SKILLS, AND ABILITIES:

·       Proficient in word processing, Microsoft Word, Microsoft Excel, Power Point, Adobe Acrobat and Microsoft Outlook.

·       Knowledge of legal documents, pleadings, and discovery processes.

·       Ability to read, analyze, and interpret legal procedures and governmental/court rules and regulations.

·       Ability to prepare pleadings.

·       Ability to effectively present information and respond to inquiries.

·       Ability to add, subtract, multiply, and divide using whole numbers, common fractions, and decimals.

·       Ability to define problems, collect data, establish facts, and draw valid conclusions.

·       Ability to interpret an extensive variety of legal instructions, pleadings, subpoenas, etc. and to coordinate appropriate compliance or objections to the same.
